REFUND

Gradskill College Australia’s refund policy outlines the refund policy and procedure in accordance with tithe the requirements Standard 3 of the National Code 2018 and the VET Quality Framework. This policy applies equally to all new and re-enrolling students unless otherwise stated, and provides the details and circumstances of applicable refunds to students where:

  • Gradskill College Australia defaults (Provider default)
  • The Student defaults (Student default)

1. Provider (Gradskill College Australia) Default

Gradskill College Australia will be considered to have defaulted when:

  • The course does not start on the agreed starting day.
  • The course ceases to be provided after it starts but before completion.
  • The course is not provided in full due to a sanction imposed on the College.
  • There is a change in the legal entity resulting in a change to RTO/CRICOS registration.

In the event of provider default:

  • Affected students will be notified in writing within 3 working days.
  • Within 10 working days, unused prepaid tuition fees will be calculated.
  • Students will be offered either:
    • Placement in a suitable alternative registered course; or
    • A full refund of unused prepaid tuition fees.
  • A written statement explaining the refund calculation will be provided.
  • If accepting alternative placement, students must sign acceptance documentation.
  • If accepting a refund, payment will be made within 10 working days.
International students ceasing studies should contact the Department of Home Affairs (DHA) regarding visa implications.

Tuition Protection Service (TPS)

  • Gradskill College Australia’s tuition fee protection is provided under the Tuition Protection Service (TPS).
  • The College maintains full compliance and current membership with TPS.
  • If the College cannot provide refund or alternative placement, TPS will attempt placement or issue a refund of unused prepaid tuition fees.

2. Student (You) Default

A student will be considered to have defaulted when:

  • The student fails to pay required course fees.
  • The student withdraws after the agreed starting day.
  • The student breaches a condition of their student visa.
  • The student is expelled due to serious misconduct.

No refunds will be made in cases of student default. Gradskill College Australia reserves the right to claim outstanding fees.

Special Circumstances

Where a student withdraws due to compassionate or exceptional circumstances, a refund of 100% of unspent fees (less administration fees) may be granted.

Examples include:

  • Serious illness (verified by medical certificate)
  • Family or personal tragedy
  • Acts of God
  • Government actions preventing course commencement

Visa Refusal

a. Visa Refusal (Before Course Commencement)

  • Full refund of tuition fees less administration fee.
  • Administration fee: $500 or 5% of tuition paid (whichever is lower).
  • Refund processed within 28 days (20 working days) of refusal notice.

b. Visa Refusal (After Course Commencement)

  • Refund of unspent tuition fees calculated based on remaining paid weeks.

c. Refund Conditions

  • Refunds will only be processed once cleared funds are received.

d. No Refund Situations

  • Visa cancelled due to breach of visa conditions.
  • Visa refusal caused by:
    • Failure to start on agreed date
    • Withdrawal from course
    • Failure to pay required fees

Non-Commencement of Studies

  • If a student accepts an offer and pays the relevant fee but fails to attend on the agreed starting date, or fails to notify Gradskill College Australia of their intentions, enrolment may be cancelled after 14 days.
  • Refunds will be calculated in accordance with the Refund Table and Refund Policy.
  • Cancellation of enrolment may affect the student’s visa status.

Deferring of Studies

  • If written notice is provided before course commencement, tuition fees may be transferred to the next available intake. New fee structures and re-enrolment fees may apply.
  • The next intake may be in the following term or later, subject to course availability.
  • An Application to Defer Studies form must be submitted in line with the Student Deferment, Suspension and Cancellation Policy.
  • If a student defers and later withdraws before the new commencement date, refunds will be assessed based on the timing and circumstances of notification.
  • Deferrals for overseas students are only approved on compassionate or compelling grounds in accordance with College policy.

Refund Process

  1. Student must complete a Refund Application Form.
  2. Supporting evidence (e.g., visa refusal, medical certificate, death certificate, travel documentation) must be attached.
  3. Applications will be assessed by the Chief Executive Officer within 10 working days.
  4. The applicant will be notified in writing of the decision and reasons.
  5. Possible outcomes:
    • Application approved and refund processed.
    • Application not approved and outstanding fees remain payable.
  6. If approved, students will receive written confirmation detailing refund calculations and CoE cancellation information.
  7. Students must continue attending scheduled classes and maintain course progress until a decision is reached.
  8. If successful, refunds will be paid within 20 working days in Australian Dollars via cheque or bank transfer.
  9. Students may appeal an unsuccessful decision (see Complaints and Appeals Policy).
  10. This policy does not affect student rights under the Australian Consumer Law.
Students are advised to contact the Department of Home Affairs (DHA) regarding any potential visa implications.

Student Rights to Appeal

  • Students refused a refund may submit a written appeal within 14 days to the Student Administration Manager.
  • The College’s appeals process does not limit the student’s right to pursue other legal remedies.
  • The right to complain or appeal does not affect rights under Australian Consumer Law.
  • Students should refer to the Complaints and Appeals Procedure for further guidance.
